NEW SANCTIONS AND INCREASING PENALTIES AT TRAFFIC LAW (DECEMBER 2018)

The Law amending the Traffic Law numbered 7148 (“Law”) has been published in the Official Gazette dated 26.10.2018 numbered 30577 and entered into force as of the publication date.  

The amendments and new penalties foreseen by the Law are as follows:  

  • An administrative fine of TL. 1.002 shall be imposed to drivers in the event of failure of issuance of registration certificate and registration plate while on highway and such drivers shall be prevented from driving until issuance of registration certificate and registration plate.
  • Driving jalopies on highway is forbidden. Administrative fine amounting to TL. 2.018 shall be imposed in case of breach of the mentioned rule. Besides, such drivers shall be prevented from driving on highway.
  • The Law prohibits installation of light and/or audible warning devices at the vehicles. An administrative fine of TL. 108 shall be imposed in case of breach of mentioned rule. In the event of breach of the rule 3 times within the one-year period starting from the last breach, such vehicle(s) shall be disqualified from the traffic for 15 days’ period.
  • Any kind of technical changes at vehicle(s) must be registered within 30 days. Such vehicles shall be prevented from driving until consummation of registration of such changes within the compliance period of the Law.
  • An administrative fine of TL. 488 shall be imposed in case of breach of the mentioned rule. An administrative fine of 488 TL shall be imposed to vehicle owners for the vehicles which are not inspected under legal terms and conditions or which are granted unsafe reports.
  • The law prohibits usage of emergency stopping lane and shoulder on the occasions other than road accident, malfunction situations, immediate aid, savings, snow survivals, accident researches, general security and public peace.
  • An administrative fine of TL. 488 shall be imposed for trucks in the event of occupy of the emergency lane. An administrative fine of TL. 1.002 shall be imposed to drivers due to change of more than one lane consecutively on the highway or drive their cars aback on one-way road which endanger the traffic.
  • In case the drivers breach “red light rule in traffic” 3 times or more within one-year period starting from the last breach, the driving license shall be suspended. Drivers who do not obey the traffic signs and whose driving licence(s) are suspended 2 times or more, shall be subject to psychiatrist examination. If such examination results positively, such drivers’ licenses shall be returned to license holders provided that such drivers shall be obliged to pay administrative fine.
  • Speed limits are determined in a manner of 3 different levels (i) An administrative fine of TL. 235 shall be imposed to drivers exceeding the speed limit from 10% to 30% (30% included), (ii) An administrative fine of TL. 488 shall be imposed to drivers exceeding the speed limit from 30% to 50% (50% included), (iii) An administrative fine of TL. 1.002 shall be imposed to drivers exceeding the speed limit over 50%. In case of breach of the abovementioned limits 5 times within 1 year, the driving licence(s) of such drivers shall be suspended temporarily. Suspension of the drivers’ licence(s) due to the same violation within five years may cause cancellation of the driving license(s).
  • The driving licence(s) of drivers shall be seized for 60 days and an administrative fine of TL. 5.010 TL shall be imposed to drivers in the event of change of the lane and swivelling the car by pulling the parking brake deliberatively.
  • The Law eliminates the obligation of pedestrians to estimate the speed and distance of oncoming vehicles. Stopping and respecting pedestrians crossing become mandatory in entrance and exit of intersection determined by the traffic lights and plates. An administrative fine of TL. 488 shall be imposed to drivers who disrespect the pedestrians crossing.
  • The use of vehicles rather than the scope of the motor vehicle registration certificate is prohibited. In the event of breach of abovementioned rule, such vehicle(s) shall be prevented from the traffic for 15 days and an administrative fine of TL. 1.002 TL shall be imposed to drivers or car owners who allow use of such vehicle(s) without motor vehicle registration certificate.  

The new sanctions and amendments foreseen by Law numbered 7148 are important not only for the safety of vehicle drivers, but also for the safety and peace of the pedestrians and the residents of the related residential areas. In addition, increase of traffic fines in a deterrent manner may allow more public transport in cities where population density is high. Thus, there may be a reduction in the risk of deaths and injuries resulting from traffic accidents in Turkey.
