LEGAL RESPONSIBILITIES AND REGULATIONS ON ARTIFICIAL INTELLIGENCE

Artificial intelligence (AI) is an increasingly important and rapidly developing field in the world of technology, and it creates significant challenges and debates in terms of legal processes and regulations. In this article, the current state, responsibilities, and regulations of artificial intelligence and law in Turkey will be discussed.

Writing a Legal Article on Artificial Intelligence and Law in Turkey: Responsibility and Regulations

1. Legal Responsibility for Artificial Intelligence

The legal consequences of decisions and actions taken by artificial intelligence (AI) systems pose significant challenges in determining liability within traditional legal systems. Current Turkish legislation does not contain specific regulations addressing direct liability for AI systems. Consequently, issues arising from the actions of AI systems are evaluated within existing legal frameworks.

a. Product Liability

AI systems can be evaluated in terms of product liability. In accordance with the Turkish Code of Obligations, the manufacturer or supplier of a product can be held liable for damages caused by the product. Therefore, manufacturers and providers of AI systems can be held responsible for damages caused by their systems.

b. Service Liability

AI systems can also be evaluated as part of services provided by service providers. In such cases, service providers can be held liable for damages caused by their services under the provisions of the Turkish Code of Obligations concerning service contracts.

2. Regulations on Artificial Intelligence and Law in Turkey

Although Turkey currently lacks comprehensive regulation on AI and law, legislation and work in this area are rapidly developing. Current regulations and work in Turkey concerning AI and law are as follows:

a. Turkish Artificial Intelligence Strategy

The Turkish Artificial Intelligence Strategy, announced in 2021, is the primary document setting Turkey's goals and policies for AI. The strategy includes goals such as creating regulatory and ethical frameworks for the development and use of AI technologies, strengthening the AI research and development ecosystem, and ensuring diversity and inclusivity in AI work.

b. Personal Data Protection and Artificial Intelligence

AI applications often involve the use of large amounts of data, a significant portion of which may include personal data. Personal data protection in Turkey is regulated by the Personal Data Protection Law No. 6698 (KVKK). Developers and users of AI systems are required to process and protect personal data used in AI applications in accordance with KVKK provisions.

c. Intellectual Property Rights and Artificial Intelligence

The development and use of AI systems also pose significant issues and debates concerning intellectual property rights. Intellectual property rights in Turkey are regulated by the Industrial Property Law and the Copyright Law. During the development and use of AI systems, compliance with intellectual property rights must be ensured, and these rights must be protected.

In conclusion, current regulations and work in Turkey concerning AI and law are continually developing parallel to the increasing importance and impact of AI systems. Legal liability for AI systems, personal data protection, intellectual property rights, and other legal issues play a significant role in shaping regulations and practices in this area. Turkey needs to implement more comprehensive and effective regulations in the field of AI and law to keep up with developments and address current issues.
